TRUSTEE'S NOTICE OF SALE NOTICE is hereby given that on Tuesday, October 20, 2015, at 11:00 oclock , A.M. at the Main Street entrance of the Cumberland County Courthouse in Crossville, Tennessee, the undersigned, as Trustee, under the following described deeds of trust, to-wit: (a)Deed of Trust executed by DEXTER W. McGREW and wife, KAE B. McGREW (the Debtors), dated January 4, 2005, of record at Book 1187, page 1744, et seq., Register's Office, Cumberland County, Tennessee, securing a Note in the original, principal sum of $71,200.00; and, (b)Deed of Trust executed by DEXTER W. McGREW and wife, KAE B. McGREW (the Debtors), dated February 9, 2007, of record at Book 1255, page 1471, et seq., Registers Office, Cumberland County, Tennessee, securing a Note in the original, principal sum of $30,000.00. By reason of default in the payment of the obligations secured by said deeds of trust and the performance of the covenants therein contained, and at the express direction of the true and lawful holder and owner of said promissory notes secured by said deeds of trust, will sell, at public auction, to the highest bidder for cash, or credit upon the indebtedness secured, at the option of the holder of the secured indebtedness if the holder is the successful bidder, the interest conveyed to said Trustee by virtue of said deeds of trust, and a portion of the property therein described, which property lies in the FIRST CIVIL DISTRICT of Cumberland County, Tennessee, and is more particularly described as follows: BEGINNING at a point in the middle of the road leading from the Memephis-to-Bristol Highway to Crab Orchard Stone Company quarry where the North boundary line of the tract of land saold by C.E. Keys et ux to Allen Hassler and wife, crosses same; thence with said Hassler line, North 82 1/2 East 38.8 poles to an intersection with the South boundary line of the Matthews land; thence with said Matthews line, North 7 1/2 West, 16.5 poles to a stake; thence south 82 1/2 West and parallel with the first line hereof to the center line of said road; thence in a Southerly direction to the plat of beginning, and containing 4 acres, more or less. Beign the same property conveyed to Dexter W. McGrew and wife, Kae B. McGrew, by virtue of a Warranty Deed dated November 23, 2004 from Audrey Dean Davis, f/k/a Audrey Dean Trevarthen, unmarried, and recorded in Book 1184, page 1618, Register's Office, Cumberland County, Tennessee. The street or mailing address of the property is 339 Rock Quarry Road, Crossville, Tennessee 38555. The property is identified in the records of the Assessor of Property for Cumberland County, Tennessee as to Map 101, Parcel 94.00. Other interested parties are: (a)Midland Funding, LLC (as successor in interest to GE Capital Retail Bank/Wal-Mart, c/o Finkelstein, Kern, Steinberg&Cunningham, P. O. Box 1, Knoxville, Tennessee 37901, by virtue of a Judgment entered on April 14, 2015, in the amount of $2,646.84, of record at Book 1456, page 1570, Register's Office, Cumberland County, Tennessee. (b)Portfolio Recovery Associates (as successor in interest to HSBC Bank, Nevada, N.A., c/o Shontay Leverett, 553 Metroplex Drive, Nashville, Tennessee 37211, by virtue of a Judgment entered on October 14, 2014, in the amount of $890.93, of record at Book 1442, page 2444, Register's Office, Cumberland County, Tennessee . (c)Daniel Cydrus and wife, Stephanie Cydrus, 353 Rock Quarry Road, Crossville, Tennessee 38555, by virtue of a Quitclaim Deed dated March 1, 2010, of record at Book 1335, page 1805, Registers Office, Cumberland County, Tennessee. The Notice of the Right to Foreclose required by Tennessee Code Annotated 35-5-117, is not required or was properly given more than sixty (60) days before the first publication of this Trustee's Notice of Sale. This sale will be made in bar of the equity and right of redemption without warranty as to title or encumbrances for the purpose of paying the debt obligation secured by said deed of trust. Said sale shall be subject to any restrictions, reservations, conditions and liens of record applicable to said property, and is further subject to any County real property taxes against said property. In the event the high bidder at the foreclosure sale should fail to comply with the submitted bid, the Trustee shall have the option to accept the next highest bid in which the bidder is able to comply or to readvertise and sell at a later date. Pursuant to Tennessee Code Annotated 35-5-104, as of the date of this Notice, there were no unreleased tax liens filed by the United States of America with respect to which the provisions of 26 U.S.C. 7425(b) require notice to be given to the United States of America in order for the sale of the land thus advertised not to be subject to such lien or claim of lien of the United States of America or filed by the State of Tennessee with respect to which the provisions of Tennessee Code Annotated 67-1-1433(b)(1) require notice to be given to the State of Tennessee in order for the sale of the land thus advertised not to be subject to such lien or claim of lien of the State of Tennessee, against the Debtors in the Register's Office of Cumberland County, Tennessee.
